recordio›Prohibited Items Rules on the Recordio Platform

This document forms an integral part of the Terms of Service of Recordio (Article 2.4) and provides detailed rules supplementing Chapter 8 of the Terms of Service.

In the event of any conflict between this document and the Terms of Service, the hierarchy set out in Article 2.4 of the Terms of Service shall apply.


1. Purpose of the rules

The Recordio platform is intended for private sales of used musical hardware between private non-business individuals (C2C model, Article 4.7 of the Terms of Service). These rules define the categories of goods and content that are not permitted on the platform.

The purpose of these rules is:

  • to protect buyers against fraud, counterfeits and dangerous products;
  • to protect copyright and other rights of third parties;
  • to comply with legal regulations (in particular consumer protection law, copyright law and the GPSR);
  • to preserve the character of the platform as a C2C marketplace for musical hardware.

2. Categories of Prohibited Items

2.1 Counterfeits and infringement of intellectual property rights

It is prohibited to offer:

  • counterfeits and unauthorised copies of goods protected by trade marks;
  • goods infringing copyright, in particular illegal copies of musical works, software, samples or documentation;
  • goods infringing patent rights or industrial design rights;
  • goods with removed, altered or falsified serial numbers, identification plates or other identification elements.

2.2 Stolen goods and goods derived from criminal activity

It is prohibited to offer:

  • stolen goods or goods derived from criminal activity;
  • goods for the sale of which the Seller does not have selling authority;
  • goods encumbered by a third-party right (pledge, enforcement seizure and similar) without that party’s consent.

2.3 Dangerous goods

It is prohibited to offer:

  • dangerous electrical equipment which, under normal use, poses a risk to the health or safety of persons;
  • equipment with a knowingly concealed safety defect;
  • equipment whose sale is prohibited by law (in particular products not meeting the requirements under Regulation (EU) 2023/988 — GPSR);
  • products without an indication of origin and manufacturer identity, where such indication is required by law.

Note on used musical electronics: Ordinary private sale of older musical equipment (amplifiers, mixing consoles, valve electronics, effects processors, synthesisers) is not prohibited solely because the Seller does not have a declaration of conformity or technical documentation for the equipment. However, the Seller is obliged to state in the Offer all safety-relevant defects, modifications or interventions in accordance with Chapter 26 of the Terms of Service (in particular electrical wiring modifications, transformer replacement, non-original power supply, unprofessional servicing, condition of mains cables).

2.4 Software, licences and digital content

In version 1.0, the platform is intended exclusively for hardware (physical goods). It is prohibited to offer:

  • software in physical or digital form;
  • plug-in licences, VST/AU/AAX licences, DAW licences;
  • sample packs, samples, instruments for virtual instruments;
  • digital content (e-books, courses, subscriptions);
  • access credentials to digital services or software licences;
  • access codes for cloud services.

2.5 Items outside the focus of the platform

The Recordio platform is focused on musical instruments and related hardware. It is prohibited to offer goods that are clearly unrelated to this focus, in particular:

  • general consumer electronics (refrigerators, washing machines, televisions with no connection to music production);
  • clothing and footwear (except for specific products for musicians);
  • furniture (except for specialised furniture for music production, such as studio desks, rack cabinets);
  • everyday consumer goods.

If there is any doubt as to whether specific goods fall within the platform’s focus, the user may contact support at support@recordio.cz.

2.6 Generally prohibited goods

It is prohibited to offer goods:

  • whose sale is prohibited by law (weapons without the relevant authorisation, drugs, counterfeit medicines);
  • which could damage the good name of the platform or of third parties;
  • whose distribution requires a special permit or licence that the Seller does not have.

3. Prohibited methods of sale

In addition to prohibited types of goods, the following methods of sale are also prohibited:

3.1 Business sales

In accordance with Article 4.7 of the Terms of Service, in version 1.0 of the platform the following are prohibited:

  • repeated sales of new goods;
  • sale of larger quantities of identical or similar items;
  • systematic or organised resale for profit;
  • sale of goods as part of a business or commercial activity;
  • any other conduct corresponding to business activity under Section 420 of the Civil Code.

3.2 Dropshipping

The sale of goods that the Seller does not physically possess is prohibited:

  • dropshipping (goods are shipped to the Buyer directly by a supplier);
  • sale of goods ordered “to order” without the Seller’s own stock;
  • sale of fictitious Offers with the intention of purchasing the goods only after receiving payment from the Buyer.

3.3 Pyramid schemes and MLM

Sales connected with pyramid schemes, multi-level marketing, door-to-door sales or other structures circumventing ordinary retail are prohibited.


4. Prohibited content in Offers and profiles

4.1 External contacts and circumvention of the platform

In Offers and before the conclusion of a purchase contract, it is prohibited to include (Article 9 of the Terms of Service):

  • telephone numbers, e-mails, IDs in instant messaging applications for the purpose of circumventing the platform;
  • links to external marketplaces, advertising services or social networks for the purpose of redirecting the deal outside Recordio;
  • requests to make contact outside the platform such as “contact me outside Recordio”.

After conclusion of the purchase contract, the platform automatically makes the necessary contact details available to the parties (Article 9.2 of the Terms of Service).

4.2 Inappropriate and offensive content

The following content is prohibited:

  • offensive, coarse, vulgar, threatening or intimidating content;
  • discriminatory content based on sex, age, ethnicity, religion or sexual orientation;
  • defamatory content or content damaging the good name of other persons;
  • sexually explicit content or content otherwise inappropriate for a public marketplace;
  • content promoting violence, hatred or illegal activity.

4.3 Misleading information

It is prohibited in Offers, profiles or communication to:

  • provide false information about the goods, their condition, defects or serial number;
  • conceal the true price by splitting it into multiple parts (for example stating an unrealistically low price with a required additional payment);
  • falsely impersonate another person or another organisation;
  • misleadingly suggest an association with the manufacturer of the goods, an authorised repairer or a distributor.

4.4 Spam and unsolicited communication

It is prohibited to:

  • publish unrelated advertising in Offers or chats;
  • send unsolicited communication to other users through the chat;
  • repeatedly list identical Offers in order to manipulate search results or visibility.

5. Consequences of breach of the rules

If this document is breached, the operator may in particular apply the following measures (under Chapter 24 of the Terms of Service):

The user has the right to appeal against the operator’s decision in accordance with Article 25.2.7 of the Terms of Service.

The operator is not obliged to refund fees already paid for removed Offers that breach this document (Article 8.4.1(c) of the Terms of Service).


6. Reporting illegal content

If a user or visitor to the platform finds content that is contrary to this document, the Terms of Service or legal regulations, they may report it through:

  • the “Report” button available on each Offer and user profile;
  • e-mail to abuse@recordio.cz;
  • for public authorities, to legal@recordio.cz.

The procedure for processing reports is governed by Chapter 25 of the Terms of Service (DSA Notice & Action).


7. Changes to the rules

The operator is entitled to amend this document unilaterally in response to changes in legal regulations, experience from operating the platform, new forms of abuse or expansion of the platform to additional national markets.

Users will be informed of material changes by e-mail and by notice in the platform interface in accordance with Article 31 of the Terms of Service.
